sue them. get a group going, they'll be all over right now. start one on facebook, twitter, all the mainstream media sites. have them all link to here. get a petition going, with signatures, then present that as a group to a law firm.
nail the pricks to a wall.

we already are, my dear. as i said before ive round together people from my area who had been ripped off by this pathetic excuse of a company, as were all huge heroes fan... or at least were... way back when 3DO handled things damned differently...
i hail from a family of lawyers and i myself am taking up law and is thinking of taking legal action against this... this is just a ripoff in ever sense of the damn word

I dont think suing is very good, or at least id leave as the very last option if you really wanna make an statement, mostly because it means wasting more money.. If you make enough noise you'll probably get refunded or get the proper CE

i would leave that as my last resort... i wouldnt even resort to such drastic measures had they had the decency to give me my money back this is just ridiculous and to think that i quite liked the game makes this a very bittersweet feeling and makes me hate UBI even more ugh
am i making sense?

If that was the problem then ubi has nobody to blame but their lack of communication. They should have made absolutely certain that everyone living under a rock for the past 30 years would know before preordering.

It says complete refunds, so I guess they'll refund the product entirely. It's also the safest way to avoid people suing them right now, given that no matter how subtle were their advertisements, it was not an isolated case of few customers, it seems. They failed at communicating it properly.
The other thing I don't grasp is why they provided physical copies for Europe and not for USA.
