Mediczero mate you have to use a new setting lol, you obviously cannot use an old setting if you are avoiding to use the Heroes IP and title for legal reason lol lol

The solution would probably be too make a new setting based of the old Era setting, but with the new mountain fortress and sanctuary faction, or in other words some of the only good things to come out of Ashan. They would have to be slightly altered though.
We might want to name our factions differently, anybody up for going back to name them after the hero classes?
Knight, Druid, Wizard, Thane, Tidecaller, Barbarian, Warlock, Necromancer, Demon lord, Beastmaster.
Sounds good?

To update you guys on what will be happening. Maybe this will answer some questions, get your hopes up a little, and maybe hopefully not destroy your hopes at the same time.
The Art of the game will be outsourced.
The programming is in good hands.
I've laid out a game plan for my friend. He was scattered brained about how to approach everything. He's currently working on a third person shooter. Over time there will be mini games released of what he's trying to accomplish overall until everything comes together. The heroes-like game will be a side project. He's aiming to get a grant from Epic so he can work on everything full time.(epic has a grant program set aside for potentially good games made in unreal engine.)
So the question is does he have the fortitude and the focus to finish it. He already has a step in this field with his brother making a successful online mmo game, purely with 3 people. So he can make it happen. That's all the info I have for you just keep this in the back of your head and maybe in the years to come it'll become a reality.

There is a handy overview of available tools, tricks and techniques for developing indie projects at Neogaf.
Also from my latest experience those Trello boards are quite useful for online tracking and task distribution.
