Underage criminals and parental responsibility

Here's a quote from Concis' post in the Americans and Ignorance thread:

The Parent is ultimately responsible until the child surpasses the legal age for adulthood

So without taking that thread off on a new tangent I decided to start a new one.

Here's my question:

Do you think parents should be penalized if they can't control their criminal children?

In America......

It depends on the crime. Crimes for juveniles(under-aged-kids convicted of crimes) are largely prosecuted by state-run institutions. And not only are they prosecuted by the state, they're also prosecuted by county, city, etc. The federal government rarely gets involved with juvenile prosecutions.

If a Governor, mayor, or congressman gets involved with such things they usually draw major media attention. Because of this it is usually seen as a political move of some kind rooting itself in deep strategy.

Details are a part of every crime. It's impossible to speculate unless given some kind of example.

The child doing the crime is the perpetrator, correct?  Or false?  Whom is the ACTUAL convict, the parent or the offspring?

A parents action can actually change the whole kids personality.
SOme parents can raise them in the right direction but the child can still lead off.
Maybe they want to live in a dream or pure pressure.
Parents cant baby sit thier kids forever,especially during thier teens.
Kids when they are young teeen understand whats right & wrong & Parents are supposed to show them the right way.
The kids have to bite into reality, Parents can only do so much.
Thier not supermen & Women you know.

There are some things that children simply don't understand. As adults, we know this. Because of this, when a child commits a crime of some kind, the child may be innocent due to the parent or legal guardian's gross neglegence to teach them right from wrong. It is legally accepted that ignorance is no excuse for breaking the law. This concept is probably about 80% applicable to adults and 50% applicable to children depending on age and other such circumstances.

That's a very broad generalization but it's the best I can give without having been given some kind of details to a specific crime.

In court, when a child is being asked to testify or is under investigation, the judge must make a decision on whether the child knows the difference between the truth and a lie. This applies to very young children ranging from age 5-10 roughly. It varies from state to state. If the judge finds that he cannot satisfactorily prove without a shadow of doubt that the child can tell the difference, then that child's testimony and/or actions cannot be used against them, or as legal testimony in a court of law. If the child's actions were of criminal nature then the parent or legal guardian will be held responsible depending on the circumstances. When Peacemaker returns she can verify this.

Well ... if the parents didn't raise the child to be a killer (who would ?) ... they are not responsable for the killing ...but i think they are responsable if the kid steals something (better not be a expensive rare diamond) ...

No, the reason I wanted people's views is that lately in the UK and Ireland, we're hearing alot of news stories about kids as young as 8 or 9 being convicted of gross public disorder charges and being slapped with bans that mean that:

They are not allowed into the city centre unless accompanied by their parents
They are not allowed out of their homes after 10pm
Violation of which will lead to them being placed in juvenile detention centres.

And then when you read the papers or see on the news their parents reaction, it's usually some bleached blond, fag-smoking pill popping single mother; who's only motivation for not having an abortion is that she could claim state benefits for being a single mother! And the father's usuallly some yob who just wants to get down to the pub, watch the football then have a good punch up on the way home.

And they're saying '(S)He's just misunderstood', or '(s)he's just hyper-active'.

It makes me sick, because in a lot of cases these young offenders will have been assaulting younger children or the elderly, or stealing from small businesses.

Urgh, I'm into a rant. It's kind of personal now. My grandmother was mugged when she was drawing her weekly pension last month and the little brats that did it won't even face a suspended sentence. Probably get off with a warning.

AND that's another thing!!
You get all these nancy-pansy psychologists working for the legal system and the government these days telling us that we should call these kids thugs, or yobs.
Or even criminals.
What the hell is that all about?

You got that very wrong Pirahna.. You see at Sighisoara a girl got drunk with me and entered alcholic coma... She could have died (thanks God she didn't...).. What would my parents would have to do with this? They surely didn't taught me how to drink( my father got drunk once in his life when he was 17)...
