1) Consent
2) Organs
3) Death (or brain death)

Once your gone, it should be mandantory to Donate Organs. I'm a firm believer of it. Your life no longer matters now, so why not help someone else who could use the help? I would want the help if I knew it was available for me.

I guess you would have to ask yourself what's more important. Your religion or helping out another human being. It's a no brainer for me to chose which.

I find it hard to believe someone would actually support mandatory organ donation. It's none of the government's damn business. The method in which a person dies and what they choose to do with their bodies after they die is one of the most personal decisions a person can make. It's entirely up to the person, or maybe their family.

Personally I think forced mutilation of a corpse against a person's will is barbaric to the extreme.

I wouldn't mind either. In fact, I'm an organ donor. But, I don't think someone should be forced to choose that option.

Right. My choice. I hate governmental involvance perhaps more than anybody here. Lassiez Faire I always say. It's up to you what you want to do. But giving your parts to others is just the right thing to do. And if it's a religious thing, then God should commend you for helping out another human being don't you think? If your God wants all your body parts on you, and does'nt want you to help out another human being, is it really the right God for you?

Organ donation falls in the category called Advanced Directives. In the US every state has them. At least some of them are mandated by the federal government, but the details and implementation are worked out by the states. Advanced Directives include such things as organ donation, wills, DNR (Do Not Resuscitate orders), Living Wills, Durable Power of Attorney, etc.

When I say mandated I don't mean people are mandated to make them. I mean the fed mandates that the states must implement the rules and legally recognize them. The various advanced directives are not necessarily dependant on each other, but they all have one thing in common. They address how society feels about certain things.

What they all have in common is that when a person is alive, they have the right to determine certain things which occur after their death. They are dead, but their wishes when they were alive still carry legal weight. They have the right to determine how their estate is distributed. They have a right to say they don't want to be brought back to life if they should die (shocked with paddles, oxygen or chemical resuscitation for example). They have the right to say they don't want to be kept alive using artificial means. And they have the right to decide if they will donate organs or not.

They may be dead, or brain dead, but their wishes when they were alive still apply. Hence the name "Advanced Directive". They make the decision ahead of time and it takes a VERY good reason to overrule their decision. Contrary to what you may hear on the news, it's very rare for wills to be challenged. Some of the other documents may be challenged more often, but mainly because of two reasons. First, many of the laws have been recently implemented and therefore have not been tested in court to discern the actual meaning and circumstances in which they apply. Second, in contrast to the supposedly unambiguous wording of the text, in reality there is a HUGE gray area as to the meaning. This is especially true with living wills.

The whole point is that we as a society not only have respect for the living, but also the dead. It's illegal to mutilate a corpse, to dig up a grave, etc. If they are dead and are nothing but bio-matter what difference does it make? It's hard to answer that, but it does make a difference.

If your mother dies you don't want to see her dumped in a trash can and hauled off to the landfill do you? You hear about a man who had a daughter who was murdered. After she died the murderer chopped her up and ate her. How do you think the father feels about this, she/it was dead and just bio-matter right? The reason it matters is that even though his daughter is dead, she's still his daughter and that will never change. Your mother is still your mother even though she is dead.

Is this totally irrational? Maybe, but that's how most people in society feel. It doesn't need to be rational. Loving them when they were alive isn't rational either, but people still love...it's just something we "feel" and no other explanation is needed.

A lot of words in there. Bottom line is I have no qualms about donating. It does'nt damper my religious views niether. I think God would condemn you to Hell for not helping out by donating. I know if I was a God, I would. "That kid needs a kidney! Your not using yours no more. And you would'nt help him out. Burn forever!"

And as far as religion, there are people who have the opposite view. They feel it's against their religion to donate organs. IMO, this falls in the category of infringement of religion for the state to mandate organ donation. So I can also see a Constitutional argument against it.

But I don't want to get into another religious discussion. There's been too many of those recently and we know where they go.

The thing is, it's really a debate about the role of government, not a debate about whether it's a good or bad thing to donate organs. Well, the thread is about those other things, but the mandate to donate is about the role of the government. As I said before, it's none of their damn business.

There are some lines the government just shouldn't cross and this is one of them.

To be honest with you, the Goverment should'nt cross any lines of anything.(Another long winded and useless debate.)
But with donation I guess there still is a narrowminded view of how Government and Religion should or should not play a role in how it's handled. Pity. I would just do it because it's the right thing to do whatever the Government or Religion tells me.

I'm not arguing against that, BUT I'm arguing against the philosophy that the government should decide for you what is the right thing for you to do.  You might argue that volunteering for medical testing is the right thing to do.  Would you be in favor of the government forcing people to submit themselves to testing of new medical technologies (pharmaceuticals, etc.) because the government judges that it's your duty as a human to do so?  Donating money to charities is the 'right thing to do'.  Should the government force you to donate your money to charities?

You must've missed a couple of posts I had here. I am totally against everything and anything the Government tells me to do. even pay taxes. To volunteer for medical experimentations, for example, is, after all, the volunteers choice. The Government has no right to intervene with this process. And if they do, then it' time to re-elect some new officials that say we don't have to. For those who can't do this, find a way to make your country go bankrupt so they can start over and change a few things. Sorry if I'm pursuing this debate about Organ Donations into a political football. Not what I wanted to do or expected. We should all agree that the Government should not tell us what to do about it. After the 9/11 thing, they've been controlling us more than ever. don't give them another excuse to add something else.
