I don't see that much similarities aside from birds with blue-ish color scheme ...
The Magic Bird is more perrot-like and egypt inspired, with many shades of blue (of actual, vibrant blue)
whereas the phoenix seems more peacock-like to me, with a much less blue color scheme (I'd say he's predominantly white) and no apparent real life inspiration (civilization wise)and in lore, they're not similar either.
But I have to say I was surprised to read that the phoenix is a Light aligned creature, I thought he was more Order aligned (with him being a servant (?) of Asha/the representation of her rebirth aspect in his h6 description, iirc).
I just wish they drew more inspiration from the NWC H5 phoenix, because it is gorgeous

Well at first everyone said how fury is full of humanoids and how similar pixie and dryad were and then it was said that they are not so similar, no one cared. And now we are debating that the blue birds are not that similar? You gotta be kidding me. The are extremely similar and everything screams that phoenix does not simply belong in sylvan.
As for retconing we could retcon everything,even demons in sanctuary, but we don't have to do that,do we?

well, who would have thought unicorns wouldn't be in H6? and hydras? and minotaurs barely made it in.

But unicorns, hydras and minotaurs are a different story, they are tied to a faction. Phoenix is not. ^^
And minotaurs were there.
I still prefer phoenix as a strongh summoning spell (Heroes V style)

I don't like the idea of this Magic Bird at all. Sylvan Phoenix symbolising the natural change of seasons is OK for me. But Academy could definitely have a more interesting alternative Champion like Dragon Golem or Sphinx, IMO.
