I always thought the law also required a certain age gap already.., so a 15-17 yo can be with a 15-18 yo, of course that still creates problems for the case of a 14 yo and a 15 yo or a 17 yo and a 19 yo, like in the example.

20 years old guy with a normal 16 years old girl : no permanent problem.
20 years old guy with a 16 years old girl that has a cop in her family : ends up on the pedo registry for life.
Have to agree, people too often use the word rape without specifying what kind it was. The difference in consequence between a 25 woman getting raped with almost no violence involved for 1 hour and a young girl that goes on for months because she has no idea what s going on or a collective rape with violence tied up somewhere for a week is enormous.

True the 'rape' wording in the the OP case is wrong. It was consensual. Unfortunately he still broke the law. Its called Statutory Rape - "sexual activity in which at least one person is below the age required to legally consent". His girlfriend was under the age of legal consent. Its sad, but its the law.
And of course, this kind of activity is not 'rape' per se. Its just two teenagers. But our laws are there for a reason. If you don't like them, you can lobby against them or vote for politicians who agree with you. But there has to be some sort of benchmark for the age of consent.
Now I am not saying that the treatment this guy received is just and fair. You would hope that in situations like this, some kind of common sense would prevail, as I don't believe a young guy should have to be labelled a sex offender for the rest of his life, including all the problems its going to cause him in the future.
But if you live in a country where there are strict laws concerning statutory rape and you commit it, be prepared for the consequences, don't bleat about it when you get caught.

Don't you see that the problem comes with the naming? (And wrong naming isn't an error, it's always an expression of a mind set.) It blows the thing out of proportion. "Statutory Rape".
What about "Statutory Kidnapping", if you are a 17-year-old, going out with a 15-year-old, and you have not delivered her back at 10 p.m. (or whatever the law says about how long you can be out without and adult)?

Reminds me of that old routine by Dave Chappelle "how old is 15 really?"
In which he observes that if 15 is old enough for a black male to be responsible enough to get the death penalty, it probably is old enough for a white girl to decide whether she wants to have sex or not/ get peed on or not.

The 17 year old is still a minor. However, I don't think we have curfew laws regarding what time teenagers get home.

Fact is that "rape" (sex without consent) is different than being a sex offender. However while the length of time that one does may be different, the label to society is the same.
The 17 and 19 year old in America is "illegal"! Rape, is illegal! However in both cases you still are registered for life! The boy in love can't go within 500 feet of a park, hang Halloween decorations, attend a public functions, or even wear a Santa costume. That is to only mention a few, plus they are both felons (good luck with a job).
The law is skewed, it needs to be refined!
