Quote: This is what makes it complicated. Landlords have property rights, but changing contracts on the fly is an issue.
Then it depends on what it originally said in the contract. Of course, if there's nothing like a "no flag" clause, then of course the landlord can't do that.

If you were to go and try 200 more types of beer and then conclude that the first one is still the best beer in the world, does it make you any more correct?
Think about it.

no it would make you pig-headed, as you can't see that the first one was rubbish in comparison to the others!
I'm sorry, but if you think an american brand of beer is the best beer in the world, wait until you try some of the local stuff in scotland, ireland, cornwall, germany and belgium.

Oh yes, indeed, I spent quite some time living in another country and have traveled all over Europe.
Anyways, I said "in my opinion" and you are free to disagree, even though disagreeing would make you wrong.

Hmm I have never been outside of America and I do not think America is the best country in the world. Nor is any other country. Every country has its problems and issues. I am happy I live in America (at least for now) because we do have more freedom then a lot of countries (that unfortunately is slowly changing). But I guess that is off topic. America is a nice country (despite what people think of us because of what they see on tv and our government), but there is no 'best' country.
As to the flag flying thing...if there is a clause in the contract I could see it..for the things they own. IE the building itself. Under no condition should they be able to tell somebody what to do with that persons personal property. Telling somebody they have to get rid of flags on vehicles is absolutely rediculous. Heck, I am not even really happy that with a clause in a contract. It's rediculous, regardless how you cut it, BUT it would be their right for THEIR property.
If they are able to tell people what to put on their vehicles what next? How to dress? What type of people they can associate with? <removed to prevent a sensless arguement> NO NO NO!

I'm an American! By God! I believe that if anyone wants to wave any country's flag in my country, you should. To ban the American flag in America makes no sense to me whatsoever! The guy should be banished from this country, it means he hates it here!
I am a veteran of the U.S. Navy. I fought for the right for people to wave the U.S. flag on American soil wherever they want!
The story shamed me. God forgive him.

My hat is off to you, as it is to all our men and women who are or have served in the armed forces. It is a shame that people do not support our troops more. Just because the idiots in the government do not know their head from a hole in a ground does not diminsh what you do even the slightest. Thank you.
We now return you to your scheduled debate

Well there really is a private property argument that could be made, but I strongly suspect this would never hold up in court, which is probably where it will end up.
But why the heck should it even go that far? It's ludicrous that a discussion should even take place about it because the entire idea is so stupid. This is probably a case where something that should be total common sense goes to court with all kinds of legal wrangling.
This is symptomatic of how people have become so oversensitive. If someone should "take offense" at it, well screw'em, that's their problem. It's part of a much bigger problem of over sensitivity. People need to get a life and quit worrying about stuff that doesn't even freekin matter.

Quote: Yes, it is illegal. He could only insert a new clause when the lease is up for renewal.
Actually from a purely legal standpoint, it is not illegal, just really outrageous to a lot of folks.
Freedom of speech is protected by the First Amendment of the Constitution. However, an abridgement of free speech is only a violation of the constitution if the entity interfering with free speech is a governmental entity. When dealing with privately owned land, the issue becomes contractual and the owner has the right to set the rules in the absence of specifically articulated topics itemized in the rental contract. The tenants can either follow the rules or move out. So unless the contract originally said something to the effect of "Tenant shall have the right to fly the flag when on the premises," which is highly unlikely, then the tenants are SOL.
I think the only possible argument would be the right of "quiet enjoyment," which is a recognized right that does not have to be explicitly stated in a rental contract. It basically flows from a kind of hybrid legal argument blending contract with equity, where the renter has earned the right to quietly enjoy the sanctity of his premises by virtue of having paid the rent. Still, under that argument the renter would only have the right to fly the flag inside his or her own unit. Once the renter passes into what they would call the "common area" then the right to quiet enjoyment ceases and a different set of laws applies.
Unfortunately I think he's screwed from a legal standpoint. The best approach is the one being pursued -- to publish the incident and bring pressure on the land owner until they relent and back off.

Think about it.
It is not the question if his statement is correct or not corribus. The way he comes to his conclusion is what I question.
You, as an educated guy refering to physics should know it even better than anyone of us.
Who draws a conclusion / states an evidence after ONE try?

That's subjective statistics and comparison (subjective because "good" beer is just personal taste), I don't see what has physics got to do with it (how did Corribus refer to physics?)

If you jump into a discussion, please read better TD.
Elodin didn't say "America is a GOOD country", he said "America is THE BEST country".
If you state something like "THE BEST", you should know about the other things you draw a conclusion on as well, because obviously you think they are NOT as good as the one you have chosen.
So of course I can say "This beer is GOOD (excellent, marvelous etc..), because those statements are no comparisons. While "THE BEST" compares with others.
Sleeping with one woman and telling afterwards she is the best in bed can't be true if there are so many more to try..

Quote: Still, under that argument the renter would only have the right to fly the flag inside his or her own unit.
Not really. The renter is renting the apartment, access to the apartment, and a parking space. Unless the flag is specifically forbidden in the contract the landlord can't forbid it. That would be like the landolord deciding to make a rule that no woman could wear a dress after the lease is signed or to then forbid a television in the apartment. It would not be valid or enforcable.
Quote: It is not the question if his statement is correct or not corribus. The way he comes to his conclusion is what I question.
You have no idea how I drew my conclusion. Furthur, I said it is MY OPINION. You are free to have the erroneous opinion that another nation is the greatest nation.
Here is exactly what I said.
Quote: I love America. It is the greatest nation on earth in my opinion and freedom has flowed from America to other parts of the world.
Now, if you were to say that in your opinion strawberry ice cream is the best ice cream in the world I would not condemn you even though my opinion is the best ice cream in the world is chocolate ice cream. You would be stating your opinion.
